Learn about the mandatory COVID-19 federal vaccination and testing details for U.S. employers

December 5, 2021 - 5:15pm

On November 5, 2021, the Occupational Safety and Health Administration (OSHA) published its much-anticipated Emergency Temporary Standard (ETS). To sum, U.S. employers with 100 or more employees must adopt a mandatory COVID-19 vaccination policy, with an option to include an alternative weekly testing program, by December 5, 2021.

This means that employers need to begin their compliance efforts with all requirements of the ETS in earnest, if they haven’t already. USI Insurance Services has summarized important aspects of the ETS for employers in an FAQ, including:

The types of organizations that must comply
State laws that may (or may not) come into play
Employee exemptions
The definition of “fully vaccinated”
Whether employers must offer a testing option, and how it works
Masking requirements
Recordkeeping and disclosure requirements
Penalties for noncomplianc
