El Salvador TPS: Protections Hold, But Decision Still Pending

El Salvador's Temporary Protected Status designation expired this week with no word yet from Department of Homeland Security (DHS) on renewal or termination — leaving restaurant employees who hold TPS in a holding pattern.

  • What Happened: DHS last year extended El Salvador's TPS designation through Sept. 9, 2026. That window closed without an announcement on whether the designation would be renewed or terminated. DHS has already terminated protections for TPS holders from Venezuela, Haiti, and other countries.
  • Where Things Stand: Officials have said that Salvadoran TPS holders retain their status and work authorization while a decision remains pending, and says an announcement will come “at the appropriate time.” DHS has not indicated when that will be.
  • A Long History, Still Unresolved: El Salvador was first designated for TPS in 2001 and has been extended repeatedly since.
  • For Employers: Continue accepting valid documentation from affected employees — reverifying early or acting on assumption, rather than an actual DHS decision, creates its own liability.
